Terms of Service

By accessing or using Gearling (the "Service"), including our Discord bot and website at gearling.net, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Gearling. Please read them carefully.

To use the Service, you must:

• Be at least 13 years old (or the minimum age required in your country)
• Have a valid Discord account in good standing
• Comply with Discord's Terms of Service and Community Guidelines
• Have the authority to bind yourself to these Terms

Gearling is a Discord bot that provides server management and engagement features, including but not limited to:

• Anti-spam and moderation tools
• XP and leveling systems
• Welcome messages and cards
• Giveaways and events
• Social media feed notifications
• AI-powered chat personas
• Automation and custom rules

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

By using the Service, you agree to:

• Use the Service only for lawful purposes
• Not attempt to exploit, hack, or reverse engineer the Service
• Not use the Service to harass, abuse, or harm others
• Not use the Service to distribute spam, malware, or illegal content
• Not impersonate Gearling or its representatives
• Not use automated scripts to interact with the Service (except the bot itself)
• Provide accurate information when required
• Keep your Discord account secure

If you add Gearling to a Discord server, you are responsible for:

• Ensuring you have the authority to add bots to the server
• Configuring the bot appropriately for your community
• Informing your server members about data collection where required
• Ensuring the bot is used in compliance with applicable laws
• Managing permissions and access to bot features

You acknowledge that Gearling collects and processes data as described in our Privacy Policy.

You may not use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Distribute illegal content or promote illegal activities
• Engage in fraud, scams, or deceptive practices
• Collect user data without consent
• Interfere with the Service's operation
• Circumvent rate limits or access restrictions
• Create competing services using our technology

Violation of these prohibitions may result in immediate termination of your access to the Service.

The Service, including its original content, features, and functionality, is owned by Gearling and is protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you create or upload through the Service. By using the Service, you grant us a limited license to process and display your content as necessary to provide the Service.

The Service integrates with third-party platforms including Discord, YouTube, Twitch, and others. Your use of these platforms is subject to their respective terms of service and privacy policies.

We are not responsible for the content, policies, or practices of third-party services. Links to external websites do not constitute endorsement.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• UNINTERRUPTED OR ERROR-FREE OPERATION

We do not guarantee that the Service will meet your requirements or expectations, or that any errors will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEARLING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or data loss
• Unauthorized access to your data
• Bugs, viruses, or other harmful code
• Actions of third parties

Our total liability for any claim arising from the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Gearling and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or share through the Service

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

You may stop using the Service at any time by removing the bot from your server and discontinuing use of the website.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Sweden. However, this does not affect your statutory rights as a consumer under EU law.

For EU consumers: You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Announcing changes in our Discord server

Your continued use of the Service after changes constitutes acceptance of the modified Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gearling regarding the Service and supersede all prior agreements.
